Commentary by Attorney Michael Grossman
The driver of the car that crashed with Botts was allegedly intoxicated at the time of the accident, though authorities didn’t specify if drugs or alcohol contributed to the accident. Believe it or not, that makes a big difference. Alcohol-related accidents are uniquely complex in that they can involve both drunk drivers and the alcohol providers that over-served them. Those establishments can face criminal charges, civil liability, and fines and suspensions from the Texas Alcoholic Beverage Commission. These consequences can be a significant way to hold those alcohol providers accountable, but they can also reassure victims and families that the people who harmed them won’t go on to harm others.
Unfortunately, these negligent providers don’t get enough attention. The reason why not a lot of people understand the difference between drug and alcohol-related crashes is because authorities typically only ever talk about the drivers. Some departments take that step to seek out negligent alcohol providers, but they’re few and far between, meaning those establishments tend to fly under the radar unless someone else is thorough enough to call them out on their behavior. Whatever exactly led up to this crash, my hope is that no one is being let off the hook.
