Commentary by Attorney Michael Grossman

A commercial truck losing control this badly is obviously a sign of a serious problem. I wouldn’t rule out something unavoidable, such as a sudden medical emergency or a tire blowout, but it’s also important to consider some possible factors that authorities rarely address in their initial investigations.

For example, the mechanical condition of trucks leading up to a serious wreck can be incredibly challenging to accurately analyze. Telling the difference between, let’s say, a manufacturer’s defect and a result of improper maintenance can be intricate. It can take special tools and training that authorities might not have access to. They also may not go to the truck drivers’ employers to pull their maintenance records and find out if the company is putting their employees behind the wheels of unsafe, poorly maintained trucks that may as well be ticking time bombs.

If investigations aren’t considering factors like that, they could be missing something crucial. And that’s just one possible set of circumstances that may ultimately be ruled out. Other possibilities can be just as challenging to investigate properly. It’s entirely possible this all was something a bit more straightforward, but it’s up to the evidence to tell the story. Otherwise, those affected by the crash may be left with questions in a time when they most deserve answers.
