How Did This Accident Occur?
If it’s true that alcohol led to this crash, a lot of people might think that makes things open-and-shut. However, some folks may think more like I do., and they’ll want to know how someone ends up behind the wheel too drunk to drive. Answering that question can be a lot more challenging than folks may realize.
For example, the details I’m seeing here remind me of a crash that I worked on a while back. A mother, a father, and their son were in their vehicle minding their own business when a drunk driver went into oncoming traffic and hit them head-on. The son was severely injured as a result. Part of our investigations included finding out where the driver had been drinking. That’s how we found out that driver had been recklessly and unlawfully over-served.
Evidence showed the man had gone out with co-workers to have some drinks at a nearby happy hour. Over the course of just a few hours, the bar served the man drink after drink to the point he could barely walk to the bathroom, let alone drive. Despite the man’s obvious danger to himself and others, the server kept pouring drinks so long as the man kept buying. Eventually, he stumbled his way out the door, into his car, and he nearly killed someone as a result.
I can’t say right now if anything like that led to this crash. However, it’s a far more common occurrence than folks realize. Texas has one of the worst rates of drunk driving accidents in the whole country, and part of the problem is the amount of alcohol providers willing to break the law and recklessly over-serve people. If investigations begin and end at the crash scene, those negligent alcohol providers are likely to slip under the radar to keep doing business as usual.
So, when drunk driving accidents happen, it’s not enough to just put all of the blame solely on the alleged drunk driver and call it a day. If evidence shows they were just drinking on their own, then at least the possibility of an accomplice can be ruled out. However, if a local alcohol provider unlawfully over-served the alleged drunk driver, then both parties should answer for their actions. Not only is that what’s best for the community, but also a family affected by their actions deserves to see accountability for those who wronged them and turned their world upside-down.
