When OSHA alleges violations after a fatal work accident, it can create the impression that the situation is clear-cut and essentially resolved. In reality, those findings rarely make a case open-and-shut. That’s especially true in Texas, since it has the most complex work accident fatality laws in the whole country.
Simply put, OSHA’s priorities are generally limited to administrative workplace safety enforcement. They generally aren’t looking out for the needs of a worker’s family. Even when violations are alleged, families may still face uncertainty about what those findings actually mean for them. Without additional steps aimed at getting the full story and exploring the family’s options, OSHA allegations can end up being only one small piece of a much larger legal maze.
