Commentary by Attorney Michael Grossman

People tend to think accidents like this are open-and-shut because authorities accused someone of driving while intoxicated. In reality, there can be significant challenges families have to be ready to overcome. For example, authorities haven’t said if alcohol or drugs were the intoxicant. If it was alcohol, are investigators looking into the possibility the intoxicated driver was unlawfully over-served? Bars, restaurants, liquor stores, and other establishments can be on the hook for contributing to a crash if someone they over-served gets people hurt or killed. But if all of the focus is just on the intoxicated, those establishments can slip through the cracks. That’s why I have to wonder if this accident is being taken seriously or if authorities are perhaps being too limited in the scope of their investigations.
