Commentary by Attorney Michael Grossman
It’s important in these situations to consider that OSHA reports rarely tell the whole story. Even when there are alleged violations, OSHA reports tend to be quite narrow in their scope. As such, navigating Texas work fatality laws (the most complex in the whole country) can take a significant amount of investigations and legal maneuvering. Folks who just assume OSHA will handle all of that typical find themselves unpleasantly surprised later on. However, those who consider all of their options and what evidence and tools they need early on to get a proper resolution will generally have the better outcomes.
