Commentary by Attorney Michael Grossman
It might not stand out to others, but when I see multiple people in a car, and only one of them ends up hurt—dead, no less—that raises serious red flags. Is there a reasonable explanation for that, or did something unusual happen? Let me explain.
Most of the time when people are involved in a crash like this, they will have at least comparable outcomes. Multiple people being unharmed while one suffers fatal injuries suggests the possibility that something which protected everyone else in the vehicle failed to protect the victim who lost their life.
Did their airbag not go off? Did their seatbelt fail? Was there something wrong with their seat? Is there an issue with the structure of the vehicle itself? Did a foreign object puncture through the vehicle?
Likely or not, these situations shouldn’t just be written off as freak occurrences or coincidences. There needs to be a clear understanding of the facts based on evidence. If authorities did that here, and they have a reasonable explanation for the victim’s unique outcome, that would be encouraging to hear. But if they missed something important, it would be far from the first time.
