Commentary by Attorney Michael Grossman
The details are still muddled here, but let’s just say, for the sake of example, that the truck made an unsafe lane change and caused this crash. Does that make things open-and-shut? In my experience, no. Let me explain why.
Even after truck accidents which have seemingly obvious causes, it’s important to know why that cause occurred. For instance, a common cause for an unsafe lane change is a driver being impatient and derelict in their duty to pay attention to their surroundings. Is that a sign the truck driver is inexperienced or poorly trained? Do they have a history of accidents or traffic infractions? Were they on their phone? Were they tired from working long hours? Were they rushing to meet an unreasonable deadline?
By getting to the root cause of a driver’s mistake, victims and families can do two things. One, they can help ensure there is as much information working to tell the story as possible. That can result in proper consequences for those responsible. Two, they can root out bad behavior that’s not obvious at the crash scene, which can correct that behavior before it goes on to harm others.
So, it’s possible there were extenuating, unavoidable circumstances leading to this crash. It’s also possible an individual driver made an isolated mistake. But considering someone had serious injuries due to this accident, there should at least be an effort to tell the whole story and not let anything slip through the cracks. Whether or not authorities have taken those steps on their own remains to be seen.
