Commentary by Attorney Michael Grossman
Right now, details allege that the driver of the vehicle was drunk at the time of the accident. Authorities recommended charges for intoxication manslaughter and intoxication assault. What I have yet to see, though, is if authorities have looked into where the alcohol came from. Obviously, drunk driving warrants appropriate consequences, but it’s illegal for bars and other alcohol providers to over-serve someone who is obviously intoxicated. Doing so means the negligent alcohol provider can expose themselves to criminal investigations, fines, license suspensions, and liability for the harm victims and families suffer as a result. Is that something that’s been looked into here?
