McAllen, TX — March 19, 2025, Edgar Charles was killed due to a workplace accident that took place off of South Old 10th Street.
Preliminary details from OSHA say the accident happened just south of the McAllen Airport near Melba Avenue.
The online OSHA statement did not specify a cause for the death of Edgar Charles. The accident apparently involved a fatal fall. OSHA listed three alleged violation citations and a recommended penalty. No further information is available.
Commentary by Attorney Michael Grossman
People might see OSHA reporting alleged violations and figure that makes for an open-and-shut process for the worker’s family. That couldn’t be farther from the truth.
In reality, Texas has the most complex work fatality laws of any other state in the country. OSHA’s priorities are not to help families navigate that legal maze. As such, families often will end up empty-handed even after OSHA has completed their investigations.
That’s why families generally need someone on their side who will prioritize their needs. Whether their path forward is through the workers’ comp system or through the victim’s employer, where they’ll have to push for a resolution that’s fair for them, having experienced allies helps overcome a lot of the obstacles that inherently come with a Texas work fatality. I don’t see any reason right now why this incident would be an exception to that.
