Generally speaking, these kinds of accidents often get swept to the side, as people assume there’s only one possible explanation of what happened. But there can be other circumstances to consider, even if they’re not too likely. A prudent investigation should at least be able to verify the condition of the crossing, whether the arms, lights, and signals were activated, whether any sort of overgrown vegetation is affecting visibility, etc. And that’s not even to mention other possible factors, such as mechanical defects, faulty safety devices, or drivers being illegally over-served by a bar. Likely or not, the evidence needs to be allowed to speak for itself.
