Commentary by Attorney Michael Grossman
While people often assume an attorney is going to be “anti-trucker,” many of the hundreds of commercial vehicle accident cases I’ve handled involved responsible professional drivers hurt due to the actions of unqualified or reckless commercial drivers. Few know better than truck drivers themselves how complex a commercial truck accident can become. It’s not always as simple as just an individual reckless driver. Sometimes, negligent employers contribute to these accidents, as well.
Did the crash involve a poorly trained or unqualified driver? Did the driver have a history of reckless behavior? Were they hauling overweight cargo? Was the truck itself in poor condition due to poor maintenance? Was this the result of a driver rushing to meet unreasonable deadlines? These are the kinds of questions investigators should be asking. Like I said, truckers know that there are companies out there that make the roads unsafe for everyone—even their own employees. It’s important, then, to make sure no such companies fly under the radar if they contributed to this accident.
