Commentary by Attorney Michael Grossman
The driver was allegedly under the influence of alcohol at the time, and authorities recommended a charge for DWI. Is that where their investigations ended, or did authorities look into where the alcohol came from?
Something that rarely gets public attention is that bars, restaurants, and other alcohol providers often play a role in drunk driving accidents. It’s illegal for them to over-serve someone who’s obviously intoxicated, and doing so opens them to potential criminal investigations, fines, license suspensions, and liability for resulting injuries.
Too often, though, authorities will file charges against a drunk driver and simply move on. Not only is that a disservice to the victims and families harmed in these incidents, it allows a reckless alcohol provider to continue unchallenged, and they’ll likely break the law again and cause more harm to the community. Maybe that all doesn’t apply here, but it’s important that the evidence has the final say on that.
