Commentary by Attorney Michael Grossman
At this time, details allege that the BMW driver was under the influence of alcohol. If that’s true, it’s rather unusual to see that at this time of the morning. It’s far more common for drunk drivers to be out late at night or in the early morning hours around when bars close. But I’ve handled hundreds of alcohol-related accident cases, and they happen at all times of day. The concern, though, is that the unusual timing can throw things off, and authorities might miss something important.
For example, if a drunk driver was unlawfully over-served by a liquor store or gas station that sells alcohol at these hours, they may be responsible for contributing to the accident. But if authorities aren’t being thorough, they may miss that and end up letting a negligent alcohol provider off the hook. That’s why it’s important every accident like this is taken seriously and given thorough investigations from experienced investigators. That way, steps can be taken to make sure nothing important slips through the cracks.
