Commentary by Attorney Michael Grossman
People often see a crash resulting in charges, and they assume everything is open-and-shut. The reality is authorities have their own job to do, and it rarely means getting victims and families the help they need. That all comes from dealing with the insurance companies. A police investigation might help in that regard, but it’s usually just one piece of the much larger puzzle for getting families the resolution they deserve.
This is why there often has to be independent investigations following the initial crash reports. Authorities may be able to put a reckless driver at fault, but did they record road conditions? Did they pull data from the vehicles to check speed and braking? Have they obtained cellphone records from the at-fault driver? Did they check for nearby cameras that captured the incident on video? Did they test for drugs and alcohol?
At the end of the day, it’s not about what you know—it’s about what you can prove. If an insurance company sees room to shift responsibility, they’re going to take it. The victims and families who leave as little room for doubt as possible will generally be the ones with the best outcomes.
