Commentary by Attorney Michael Grossman

While alcohol was not confirmed as a cause of this accident, it obviously raises red flags anytime it comes up as a possibility. Not only could there be serious consequences to consider for a potentially drunk driver, but there could be a complex investigation ahead if that driver was unlawfully over-served by an alcohol provider.

In Texas, drunk drivers and alcohol providers can both be responsible for contributing to a serious crash. If somewhere like a bar, for example, serves someone who is obviously intoxicated, and that person’s intoxication leads to people getting hurt or killed, alcohol providers can face consequences. These can include fines, suspended licenses, criminal investigations, and liability for the resulting injuries.

The reason I bring this up specifically is because it often goes overlooked. I’ve handled hundreds of alcohol-related accident cases. Rarely do authorities take it upon themselves to investigate beyond a crash scene. That’s especially true if they already have a drunk driver to file charges against. So while it’s not yet clear if alcohol was indeed a factor in this crash, there is more than enough reason to be concerned whether or not authorities are truly giving this accident the attention it deserves.
