Commentary by Attorney Michael Grossman

If the images of this stretch of road I’ve seen are up to date, it would seem a vehicle turning off of Fairview would have to yield to highway traffic. Does that mean the truck here failed to yield while turning onto the highway? People generally think something that serious would come out in the initial reports, but authorities aren’t always so thorough in their investigations. In fact, I’ve handled cases where investigations were just plain wrong.

For example, there was a case not long ago where a family was told their loved one was speeding and not wearing a seatbelt when they hit a tractor-trailer turning across a dark highway. They wanted a second opinion because they knew their loved one was a safe driver. As we dug into things, key details came to light. For one, a reconstruction of the scene and the vehicle’s frozen speedometer proved the victim was going at reasonable speeds. Secondly, numerous emergency responders we spoke to testified they had to cut through the victim’s seatbelt to get them out of the wreckage. And to top things off, our inspection of the truck involved showed its reflective tape on the trailer was so caked in dirt that it would have been all but invisible at the time of the crash.

It was only after gathering a mountain of evidence that the family was able to get the whole story and reach a just conclusion to their situation. If they had simply taken authorities at their word, there’s no telling if the truth ever would have come to light. So it could be that authorities here are simply being reserved until they have more information to report. But if they’re not taking steps behind the scenes to ensure the victim’s loved ones are getting clear answers, then it’s possible their efforts alone won’t be enough to get a just resolution to this incident.
