Commentary by Attorney Michael Grossman
Initial crash reports often leave us with more questions than answers. This one is no different, so there are some critical questions that must be answered in a top-notch investigation.
1. Did the authorities thoroughly investigate the crash?
Initial reports suggest that the cause of the crash is unknown, which leaves significant gaps that need to be addressed. A comprehensive investigation should include:
- Road conditions: Authorities should examine whether road hazards, such as debris, potholes or poor signage, contributed to the crash. Weather conditions at the time should also be reviewed.
- Crash site examination: Investigators should analyze skid marks, debris and the vehicle’s trajectory to determine whether the vehicle left the roadway due to loss of control, avoidance of an obstacle or other factors.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
Vehicle defects or malfunctions must be thoroughly considered, especially when a vehicle veers off the road unexpectedly. Specific areas to investigate include:
- Steering system failure: A malfunction in the steering mechanism could cause a loss of control.
- Tire or suspension issues: A blowout or failure in the suspension system could lead to the vehicle leaving the roadway.
- Electronic systems: Modern vehicles like the 2021 Kia Soul often have advanced driver-assistance features. Investigators should verify whether these systems functioned as intended or if they contributed to the crash.
A detailed inspection of the Kia Soul is necessary to rule out these possibilities.
3. Has all the electronic data relating to the crash been collected?
The vehicle’s onboard systems likely contain valuable data that can shed light on the cause of the accident. Key data to retrieve includes:
- Engine Control Module: This device may record critical information, such as speed, steering inputs and braking activity, in the moments leading up to the crash.
- Maintenance and recall records: Reviewing the vehicle’s service history and any recalls can help identify whether known issues with the Kia Soul may have played a role.
- Cell phones:
Preserving and analyzing this data is essential to uncovering the truth behind the crash.
Why are these questions so important? I believe they will help the victim’s family understand what happened here. That is what they deserved after losing a loved one to a traffic accident.
