Commentary by Attorney Michael Grossman

After accidents allegedly involving alcohol, people generally think the investigations begin and end behind the wheel with the alleged drunk driver. That does tend to be where investigations end, but they should go far beyond the crash scene. One key detail to consider is where the driver got their alcohol from and whether or not that alcohol was served legally. Here’s why that’s important.

In Texas, alcohol providers who over-serve obviously intoxicated persons can be responsible if that intoxication leads to people being hurt or killed. Whether that’s a bar, a restaurant, or even a grocery store, violating the rules of alcohol service in Texas has consequences—or it should, at least.

Too often, I see situations like this where authorities simply charge the alleged drunk driver and move on. Meanwhile, there could be a negligent alcohol provider who contributed to someone losing their life, and they may still be putting the community in danger. Both for the sake of the victim’s family and the community as a whole, negligent alcohol providers should always be part of the investigations into accidents like this. It remains to be seen if those steps are being taken here.
