Commentary by Attorney Michael Grossman

Obviously any mention of alcohol is concerning, but people don’t often consider what it means beyond just finding a driver to blame. Here, both drivers involved lost their lives. That makes it even more important to consider if there was an outside party responsible for contributing to such a serious accident. Simply put, if an alcohol provider over-served the alleged intoxicated driver, they may be responsible.

Texas law says bars, restaurants, liquor stores, and other such venues who serve obviously intoxicated persons are doing so unlawfully. This exposes them to potential criminal investigations, fines, and liability when people get hurt or killed as a result. However, I’ve handled hundreds of cases against negligent alcohol providers, and these aren’t details police investigations typically consider on their own. Countless times, I’ve had families come to me for help, and authorities had already moved on without so much as a passing glance at the possibility an alcohol provider contributed to their wreck.

It could be that authorities here have been more thorough. Maybe evidence will confirm factors other than alcohol led to the crash. Or, perhaps there were no negligent alcohol providers involved in this accident. However, there are families out there going through indescribable hardship because of this crash. If nothing else, there needs to be assurance that they’re at least getting the whole story. Authorities looking into the possibility of alcohol may be just the beginning of that story.
