Commentary by Attorney Michael Grossman
When it comes to single-vehicle accidents, I’m always concerned whether or not they’re getting the attention they deserve. Unfortunately, they tend to be a low priority for authorities, so they can easily miss important details, especially if it’s something they’re not used to investigating on their own.
For example, I handled a case a while back where authorities blamed someone for not wearing their seatbelt. The family was confused, since they always knew the victim to be very safety conscious. Well, it turns out the victim had their seatbelt on, but there was a defect that kept it from locking properly. As a result, the victim suffered serious injuries that otherwise could have been prevented.
At the end of the day, if authorities don’t spend the time and resources necessary to conduct a proper accident reconstruction, something is bound to slip through the cracks. Perhaps they were more thorough here than these initial details suggest, but that’s not the sort of thing I would take for granted.
