With any crash possibly caused by alcohol, there should obviously be appropriate consequences for the alleged drunk driver. However, accountability might not end there. It’s also important to know where the alcohol came from and if a negligent alcohol provider unlawfully served it.

Put simply, it’s unlawful in Texas for bars, restaurants, liquor stores, and other businesses to over-serve someone who is obviously intoxicated. If they do so, and that leads to people being hurt or killed, the alcohol provider can be responsible for their role in the accident.

Unfortunately, this often slips through the cracks. I’ve handled hundreds of cases involving negligent alcohol providers. Countless times, I’ve seen authorities begin and end their investigations behind the wheel. While the drunk driver got their day to answer for their actions, a negligent alcohol provider was allowed to ride off into the sunset—except that the victims and families were prudent enough to demand the whole story.

So if it’s true that alcohol was a factor here, that doesn’t make things open-and-shut. Investigations must be thorough enough to ensure that all wrongdoers face appropriate consequences. Whether that’s a single reckless driver or a drunk driver put behind the wheel by a law-breaking alcohol-provider, it’s up to the evidence to say for sure.
