Commentary by Attorney Michael Grossman
With single-vehicle accidents like this, there’s a concern that authorities might not see the situation as a high priority. This sometimes results in officers moving on without getting all the facts or otherwise making mistakes during limited, “by the book” investigations. That can obviously be troublesome for families who urgently need answers, which is why it’s important to be proactive with the authorities and make sure they don’t miss anything important.
For example, whenever I look at a report from an accident reconstruction, there are many factors I expect to see addressed. Did the vehicle experience any malfunctions? Does it have known manufacturing defects? Did a tire blow out? What were road, light, and weather conditions? Are investigators certain it was a single-vehicle accident, or are there any signs of another vehicle that fled the scene? Was the driver in any way incapacitated or impaired? Does that area get an unusually high number of accidents? Did the victim’s airbags and seat belt work properly?
Even when it’s just out of an abundance of caution, investigating these and other possibilities helps to ensure that even less-common factors are caught. If authorities don’t seem to be asking enough questions, it could mean they don’t have the time or resources to give the accident the thorough attention it deserves.
