Commentary by Attorney Michael Grossman

Regardless of what led this accident, it’s important to know that Texas has the most complex work fatality laws of any other state in the country. Despite what many think, there is not always a guarantee that families will receive the benefits they need after a loved one dies on the job. There are also situations where employers are up against families. Across more than 30 years of handling fatal work accident cases, I can’t recall a time where an employer put the needs of a family first.

So, as important as it is to know what OSHA finds out through their investigations, waiting around for clear answers just isn’t ideal, to say the least. It’s important for those affected by a fatal work accident to have the evidence, tools, and allies working on their behalf to get a fair resolution.

In short, families deserve to know what happened, they deserve to have a clear path forward, and they shouldn’t have to wait for months or years to get those things.
