How Did This Accident Occur?
It’s not my place to speculate about the exact specifics of what happened here. I’ve seen work accidents happen due to everything from poorly maintained machines failing to workers not having proper safety equipment to workers being forced to do work recklessly for the sake of time or to cut costs. It’s even possible this incident was something unusual and unavoidable. That’s all up to the evidence to say.
What I do want to stress to folks, though, is that work accidents are rarely open-and-shut. Texas has the most complex work fatality laws in the whole country. OSHA tends to focus on their own priorities, and the needs of the worker’s family may be brushed aside as they focus on those priorities. So, navigating the legal maze of Texas work fatality laws may take the family seeking avenues beyond just waiting for the authorities to finish their jobs. Otherwise, important evidence could slip through the crash, and questions may go unanswered. Taking steps early on to focus on those potential gaps, however, can help ensure that the family gets the full story.
