Commentary by Attorney Michael Grossman

One thing that concerns me with any accident like this is whether or not it’s being treated as a priority. Sometimes, departments allow bias to sway their efforts, and they might jump to conclusions about a bicyclist on a dark highway rather than just letting the evidence speak for itself.

For example, did authorities look for any video evidence of the accident? A lot of commercial trucks have dash cameras and even cameras in the driver’s cabin. It could also be that one of the nearby businesses had a security camera with a view of the road. This evidence tends to be time sensitive, so if authorities leave it alone for too long without preserving it, it may be lost.

That’s just one example, but I find that knowing even one important question to ask can put a family on the right track. Generally speaking, if authorities can get them clear answers, it’s a sign the investigations are being handled properly. If the responses fall short, though, that can be a sign that another set of eyes needs to be looking things over before something important slips through the cracks.
