Commentary by Attorney Michael Grossman

When a driver admits to drinking before making a dangerous turn that leads to a serious crash, it raises an important question: Where did he get his alcohol?

Under Texas law, bars and restaurants are not allowed to serve alcohol to someone who is already obviously intoxicated. If an establishment ignored that responsibility and overserved this driver, they may share accountability for the harm that followed.

Dram shop laws exist to hold negligent alcohol providers accountable and to promote responsible alcohol service. A full investigation should determine whether a bar or restaurant contributed to this crash by continuing to serve an intoxicated person. Ensuring accountability isn’t just about this case: it’s about preventing future crashes caused by unlawful alcohol service.
