Commentary by Attorney Michael Grossman
This soon after a chaotic accident like this, it’s not unusual for there to be few details available. The concern is if authorities are taking steps behind the scenes to give the crash the attention it deserves. That’s why I always consider some key questions early on.
- Are authorities dedicating the time and resources necessary for investigations?
Not all departments prioritize accident reconstruction. This can leave officers without the time or equipment needed from a proper investigations, which can allow important details to slip through the cracks. - Have the vehicles been inspected for potential defects?
Likely or not, sudden mechanical issues can cause a driver to lose control. Also, issues with things like airbags or seatbelts can turn survivable crashes into fatal ones. These possible defects require far more in-depth inspections than most basic crash investigations offer. - Is electronic evidence being preserved?
This includes obvious things, such as cellphones and dashcams, as well as less obvious things, like vehicle data and cameras from nearby homes or businesses. This evidence can be time sensitive, so the sooner it’s secured, the better.
These questions can help victims and families gauge how the investigations are being handled. If authorities have solid answers, it’s generally a sign they’ve done good investigations. If their answers are lacking, and things aren’t adding up, there may need to be more thorough independent investigations.
