Commentary by Attorney Michael Grossman
A vehicle losing control like this might raise some common red flags. However, it’s always important to let the evidence speak for itself. Even uncommon possible factors, like sudden vehicle defects, need to be thoroughly investigated to at least rule them out. Not only do the victims recovering from the crash deserve to know all the facts, but the family who lost their loved one deserve to know the full story, as well. If authorities can show they’re considering all of these extenuating possible factors, that would be encouraging. In my experience, though, that usually requires input from independent accident reconstructionists who have the tools and training officers rarely have access to.
