Commentary by Attorney Michael Grossman

When I read about a crash like the one in Pflugerville, I think about how quickly people can rush to conclusions, especially when the driver is young and reportedly unlicensed. But as serious and alarming as that detail is, we still need to step back and ask the broader questions that can uncover all the contributing factors. That’s why in any fatal crash, especially one as complex as this, it’s critical to ask: Did the authorities thoroughly investigate the crash? Has anyone looked into the possibility that a vehicle defect caused the crash? Has all the electronic data relating to the crash been collected?

Beginning with the investigation, the crash occurred just after 3 a.m., a time when darkness, low traffic volumes and driver fatigue can all come into play. Reports say the 2022 Ram 1500 veered off SH-130 near Kelly Lane and hit a wall. A proper investigation should include detailed accident reconstruction, documentation of road conditions and scene measurements to determine how and why the vehicle left the roadway. Investigators should also be asking whether another vehicle was involved, even indirectly, or whether an evasive maneuver was attempted. While the fact that the driver didn’t have a license will understandably be a focus, it’s important not to let that detail overshadow a full analysis of the crash itself. Passenger families, especially in fatal cases, deserve answers grounded in more than just assumptions.

Next, it’s important to examine whether a vehicle defect might have contributed. The truck involved is a newer model with many advanced driver-assistance systems. If any of those systems failed or misfired — such as lane-keeping assistance, brake assist or stability control — it could have led to or worsened the crash. Likewise, a mechanical failure involving steering, tires or suspension could cause the vehicle to leave the road unexpectedly. Because the vehicle is newer, people may assume it’s less likely to have defects, but the truth is that modern technology is not immune to failure. Diagnosing a defect requires that the truck be preserved and examined by experts—, something that doesn’t always happen unless someone insists on it early.

Finally, we have to ask whether electronic data from the vehicle has been collected. A 2022 Ram is equipped with an engine control module capable of storing vital crash-related information, including vehicle speed, braking, steering input and whether safety systems like ABS or electronic stability control activated. This data is often the most accurate account of what the vehicle was doing in the seconds before impact. In addition to that, phone records, GPS data and potential footage from traffic or security cameras near Kelly Lane could also provide valuable context. However, this evidence is time-sensitive and must be preserved quickly before it is overwritten or lost.

In the wake of a crash that resulted in a man’s death and left another seriously injured, it’s critical to take the time to understand exactly what happened, not just who was behind the wheel. Answering the hard questions about the investigation, the vehicle itself and the available data is the only way to get a complete picture. And for the families affected, it’s the least they deserve. The goal isn’t just to assign responsibility: it’s to ensure no possible explanation is left unexplored.
