Commentary by Attorney Michael Grossman

When I see reports of a single-vehicle crash like this, my first thought is whether investigators will be able to determine exactly what went wrong. It’s easy to assume that a driver simply lost control, but my experience tells me that’s not always the case. Instead of making assumptions, it’s important to let the evidence tell the story. To do that, there are three critical questions that need to be answered.

The first question is whether authorities conducted a thorough investigation. Law enforcement works hard to document crash scenes, but not all agencies have specialized training in accident reconstruction. In a case like this, where a vehicle left the roadway for unknown reasons, investigators should be examining tire marks, roadway conditions, and any potential environmental or mechanical factors that could have contributed. Without a detailed review, important pieces of the puzzle could be overlooked.

The second question is whether a vehicle defect played a role in the crash. A sudden loss of control can sometimes be linked to mechanical failures, such as steering malfunctions, braking issues, or stability control problems. The Chevy HHR involved in this crash should be preserved for a forensic examination to rule out these possibilities. Unfortunately, vehicle defects often go undiagnosed because the car is quickly disposed of or written off as an accident without further scrutiny.

The final question is whether all available electronic data has been collected. Many vehicles, including the Chevy HHR, are equipped with an electronic control module (ECM) that records critical details such as speed, braking, and steering inputs leading up to the crash. Additionally, cell phone data, surveillance footage, or dashcam recordings could provide further insight into what happened. If investigators don’t take steps to secure this information quickly, it may be lost before anyone realizes its value.

At the end of the day, getting to the bottom of a crash like this isn’t just about documentation—it’s about ensuring that all the right questions have been asked and answered. If external factors, vehicle defects, or missing data played a role, the family of the person who lost their life deserves to know. Serious crashes change lives in an instant, and at the very least, the community owes it to those affected to uncover the truth.
