Commentary by Attorney Michael Grossman

Whenever I read about a serious crash like this, my initial thought is that I hope everyone involved gets answers to how the crash happened in the first place. That may sound like a simple task, but over the years doing what I do, I’ve seen numerous examples where seemingly clear-cut crashes turn out to be far more complex than they appeared to be at first blush.

Contrary to what most people think, the quality of a crash investigation can vary a great deal. What makes a competent crash investigation? There are three factors in my experience that separate a good crash investigation from one that is lacking.

First, authorities need to cover the basics. Accident reconstruction, identifying and speaking to witnesses, and securing the crash scene evidence is a good first step. Beyond that, it’s important not to rule out the possibility of a vehicle defect. Lastly, it’s imperative to collect all electronic data related to the crash. This must include engine control module data from the vehicles involved, any surveillance footage, and lastly, cell phone data from those involved.

If authorities touch all those bases, then in all likelihood they’ll be in a position to answer all the questions that those involved may have. If they can’t, then it’s incumbent on those affected to find someone who can get them the answers they need.
