Commentary by Attorney Michael Grossman
In my line of work I’ve come to realize that while no two accidents are the same, neither are their investigations. Typically, authorities fail to address some or all of the most important questions that are vital in any accident investigation.
1. Did the authorities thoroughly investigate the crash?
Nothing is ever “straight-forward” in a serious accident such as this, and ensuring that every available piece of information is collected is vital in providing answers to the circumstances of the crash. Key elements to examine include:
- Whether law enforcement collected witness statements and physical evidence from the scene.
- If accident reconstruction specialists were brought in to determine the events leading up to the collision.
- An analysis of road design or traffic conditions at the intersection of 50th Street and Avenue Q, which might reveal contributing factors such as obstructed views or inadequate signage.
Though law enforcement may be attempt to be diligent in their investigation, they are sometimes hindered by a lack of resources or training. That’s when it becomes necessary to bring in independent experts to reconstruct the accident to ensure nothing is missed.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
It’s crucial to consider whether a defect in the vehicle could have played a role in the accident. Mechanical, design, and software defects are all potential areas of concern, however that valuable data could be lost if steps are not taken to ensure the vehicles involved are preserved.
Preserving access to the vehicle for forensic examination is critical, as repairs or disposal could erase vital evidence of a potential defect.
3. Has all the electronic data relating to the crash been collected?
Electronic data is often the key to reconstructing the moments leading up to an accident. Modern vehicles are equipped with electronic control modules (ECM’s) also called “black boxes” which can be crucial in providing data on vehicles leading up to a collision. This could include:
- Speed, braking, and other operational details.
- Whether or not airbags and any other crash and injury prevention methods were deployed properly.
- Any fault codes which could indicate a mechanical defect.
In addition data from the vehicle, surveillance and traffic cameras footage can be very important, as well as cell phone data. Cell phone data can be critical as it can help provide insights into what was happening just before the crash.
In the end, if investigators can answer these important questions then there is typically nothing left to be done. If they cant however, then the burden usually falls on the family to seek independent experts to perform an investiagtion
