Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that I hope investigators take every possible step to determine exactly what led to this incident. A vehicle traveling the wrong way and colliding with multiple others before catching fire raises several questions, and while some might assume the cause is clear, experience has shown me that crashes like these are often more complicated than they appear. To fully understand what happened, there are three critical questions that need to be addressed.
First, did the authorities thoroughly investigate the crash? Wrong-way crashes are often assumed to result from driver impairment or confusion, but without a detailed investigation, it’s impossible to say for sure. Law enforcement officers should examine all possible contributing factors, including road signage, lighting conditions, and whether any other vehicles played a role in the wrong-way entry. Additionally, given that multiple vehicles were involved and a fire occurred, accident reconstruction specialists should analyze the scene carefully to ensure that no crucial details are overlooked.
Second, has anyone looked into the possibility that a vehicle defect contributed to the crash? While driver error is often assumed in wrong-way collisions, mechanical failures—such as steering malfunctions or unintended acceleration—could have played a role. Additionally, given that the vehicle caught fire after the crash, it’s worth questioning whether a defect in the fuel system or electrical components contributed to the fire’s severity. Unfortunately, vehicle defects are often overlooked in crash investigations because law enforcement agencies typically lack the resources to conduct forensic examinations. Ensuring that the vehicle is preserved for further analysis is critical if there’s any suspicion that a mechanical issue played a part.
Finally, has all the electronic data relating to the crash been collected? Most modern vehicles are equipped with electronic control modules (ECMs) that record key data such as speed, braking activity, and steering inputs leading up to the collision. This information can provide valuable insight into whether the driver attempted to correct their course or if a mechanical issue prevented them from doing so. Additionally, surveillance footage, dashcam recordings, and cell phone data could help clarify the events leading up to the crash. If authorities fail to secure this evidence promptly, important details could be lost, making it harder to fully understand what happened.
At the end of the day, crashes like these leave many unanswered questions, and it’s essential that every possible factor is considered in the investigation. Serious wrecks disrupt lives, and the least we can do as a community is ensure that those affected receive a full and complete explanation of what occurred. Until all the facts are known, it’s important to avoid assumptions and let the evidence tell the full story.
