Commentary by Attorney Michael Grossman

When I see reports of a crash like this, my first thought is that the injured pedestrian and others involved deserve clear answers about what happened. A collision involving a disabled vehicle, a moving SUV and a parked truck raises serious questions, and in my experience, these incidents often involve more complexity than they first appear. Before any conclusions can be reached, three key areas need further investigation.

First, did authorities conduct a thorough investigation? When a crash involves a disabled vehicle, it’s crucial to determine whether other drivers had enough time to see and react to it. Did investigators check whether the Chevrolet Equinox had its hazard lights on? Were there any visibility issues, such as poor lighting or road design, that could have affected reaction time? Additionally, where was the pedestrian at the moment of impact: was he attempting to assist with the disabled vehicle, or was he standing in an unexpected location? A full accident reconstruction should clarify these details.

Second, has anyone looked into whether a vehicle defect contributed to the crash? Both the Infiniti QX60 and the Chevrolet Equinox are relatively modern vehicles, but mechanical failures can still occur. Did the Infiniti’s brakes or collision-avoidance systems function properly, or was there a delay in the driver’s ability to stop? Did the Chevrolet Equinox become disabled due to a mechanical failure that should have been investigated, such as an electrical issue or engine shutdown? If either vehicle experienced a malfunction, a forensic inspection would be necessary to rule out mechanical or electronic failures.

Finally, has all available electronic data been collected? Many vehicles, including the ones involved in this crash, likely have engine control modules (ECMs) that store key information such as speed, braking and steering inputs before the crash. Retrieving this data could help determine whether the Infiniti driver attempted to brake or if the vehicle failed to respond as expected. Additionally, authorities should check for any nearby traffic or surveillance cameras that may have captured the crash. Phone records should also be reviewed to determine whether distraction played a role.

At the end of the day, a pedestrian suffered serious injuries, and multiple vehicles were involved in this crash. Those affected deserve to know exactly what happened. A full and thorough investigation is the only way to ensure that no key details are overlooked. If any of these three questions remain unanswered, the victim and his family simply don’t have the full story.
