Commentary by Attorney Michael Grossman

A big part of accidents like this is visibility and whether or not a crash was reasonably avoidable.

If a car crashes and immediately veers into someone’s path, or if it’s blocking lanes of travel on a dark highway without any visible lights on, it wouldn’t really be reasonable to blame someone for hitting that vehicle in most circumstances.

However, if evidence shows a car was clearly visible, and an attentive driver would be able to see and avoid it, a driving failing to avoid it would raise red flags.

As such, when I read about a crash like this, my question is simple: What does the evidence say?
