Commentary by Attorney Michael Grossman
As open-and-shut as this all may seem, it’s important that victims and families always have as much evidence telling their side of the story as possible. Authorities may file charges against another driver, but insurance companies are still going to look for any opportunity possible to muddy the waters and shift blame.
That’s unfortunately easier when victims are on a motorcycle, since a lot of people are already biased against motorcyclists. But if there is a solid foundation of evidence working in the victim’s favor, people can ensure they get the best outcomes possible. Whether authorities were able to investigate beyond just what they needed for their own purposes remains to be seen.
