How Did This Accident Occur?

When it comes to pedestrian accidents late at night, a lot comes down to whether or not the pedestrian was visible or reasonably avoidable. As much as people think right-of-way is all that matters, that may just be one piece of the puzzle. For example, if investigators find that a pedestrian was outside of a crosswalk, but they were in a well-lit area where a driver could see and avoid them, a driver failing to avoid them would raise some serious red flags about the driver’s behavior. Otherwise, if the pedestrian was just in a place they shouldn’t have been, it’s important investigations look into why.
