Commentary by Attorney Michael Grossman

There are obviously all kinds of factors to consider after a car accident, but one thing in particular stood out to me in these preliminary statements. It appears three people were involved in the crash, yet only one person had reported injuries—serious ones. So why was their outcome so drastically different from everyone else? Here’s why that stands out.

A lot of the time, one person being seriously injured while everyone else is find can just be a natural result of the circumstances of the crash. The direction of impact, for example, can influence this quite a bit. Sometimes, though, it can be a sign that something which protected everyone else failed to protect the victim. Did their seatbelt not work? Did an airbag not go off? Did their seat stay in place? Is the structure of the vehicle flawed in some way?

This is something that needs to be examined carefully by investigators. Even if something like a serious defect is ultimately ruled out, that can help the victims and families involved in a crash put all the pieces together. So if authorities are looking or have looked into possible defects here, that would be good to hear. In my experience, though, something that delicate usually needs more thorough independent investigations.
