Commentary by Attorney Michael Grossman
When I see reports of a crash like this, my first thought is that the injured pedestrian and their loved ones deserve clear answers about what happened. A vehicle striking a pedestrian at night raises several important questions, and in my experience, these types of crashes often involve more complexity than they appear to at first glance. Before anyone can fully understand what led to this incident, there are three critical areas of investigation that should be addressed.
First, did authorities conduct a thorough investigation? Pedestrian crashes often involve visibility issues, and given that this happened at 10 p.m., lighting conditions may have played a role. Did investigators assess whether streetlights were functioning properly? Did they consider whether the pedestrian had enough time to cross safely or if the road design made crossing dangerous? Witness statements, surveillance footage and a proper reconstruction of the scene are all necessary to get a complete picture.
Second, has anyone looked into whether a vehicle defect contributed to the crash? The Dodge Avenger involved is a 2013 model, meaning it’s over a decade old and could have experienced issues with its braking system, headlights or other critical components. If the headlights were dim or malfunctioning, that could have affected the driver’s ability to see the pedestrian in time. If the brakes were worn or defective, the driver may not have been able to stop as quickly as expected. Without a forensic examination of the vehicle, it’s impossible to rule out these possibilities.
Third, has all available electronic data been collected? The Dodge Avenger likely has an engine control module that could provide crucial details about the driver’s actions leading up to the crash, including speed, braking and steering inputs. Additionally, surveillance footage from nearby businesses or traffic cameras could show whether the pedestrian was visible to the driver and whether either party took evasive action. Cell phone records should also be checked to determine if distraction played a role. These pieces of evidence can help paint a clearer picture of what really happened.
Crashes like this leave more questions than answers, and the least the community owes those affected is a full and complete investigation. If any of these three questions remain unanswered, it’s possible that key details are being overlooked. Until we can confidently determine why this crash happened, we simply don’t have the full story.
