Commentary by Attorney Michael Grossman

When alcohol is mentioned as a potential factor in a crash like this, it raises important questions that go beyond a driver’s actions. One critical issue to consider is whether an alcohol provider contributed to the situation by over-serving someone who was obviously intoxicated.

Under Texas dram shop laws, bars, restaurants, and other alcohol providers can be held accountable if they over-serve someone who later causes harm. If one of the drivers involved in this crash was drinking prior to the incident, it’s essential to investigate where they were served alcohol and whether the provider followed the law.

These investigations are about more than just assigning blame—they play a vital role in promoting public safety. Holding alcohol providers accountable when they break the law reinforces the importance of responsible alcohol service, which can help prevent future crashes. So if alcohol indeed was a factor here, it’s important to know how thorough authorities have been so that nothing important slips through the cracks.
