Commentary by Attorney Michael Grossman

With a situation like this, it’s just as important to find out what caused the crash as it is to know what caused the injuries. The answer isn’t always the same. Here’s why I say this. Generally speaking, when two people in the same vehicle suffer a drastically different severity of injuries, it’s important to know why that is. Sometimes, there can be a reasonable explanation simply due to the circumstances of the crash. Other times, it’s a sign something unusual happened, such as an airbag not going off or a seatbelt being defective, for example.

Frankly, that isn’t the sort of thing most police departments look into on their own, so it wouldn’t be surprising if authorities here hadn’t considered these possibilities. If that’s the case, then it’s important there are more thorough accident reconstructions to ensure no possible factor, however unlikely, slips through the cracks.
