Commentary by Attorney Michael Grossman
If it’s true that a semi driver failed to yield here, it’s important to find out why that happened. People tend to just be content blaming the driver and moving on. However, I’ve handled hundreds of commercial vehicle accident cases, and there’s often more to the story.
For example, was the driver being pressured to meet unreasonable deadlines? I had a case not long ago where a company routinely pressured drivers to meet unreasonable delivery windows. Drivers had to cut all kinds of corners to do so. When they did, they were rewarded. When they failed, they risked losing their jobs. Naturally, this led to drivers taking risks out on the road rather than risking their livelihood.
That sort of behavior is a lot more common than folks realize, and it can continue putting lives at risk unless someone roots out the behavior and sets things right. Maybe all that would take here is seeing a negligent driver held accountable for their mistake. But if there’s more to this story, the victims involved deserve to know it’s being addressed.
