Commentary by Attorney Michael Grossman
I find that when people see a rear-end collision like this, they just assume the rear driver must have been on their phone. Don’t get me wrong—that’s a common explanation, and it’s the first thing we look into after any serious accident. However, jumping to conclusions without considering other possible circumstances is irresponsible. For all we know, this was due to road hazards, a medical emergency, mechanical issues, some sort of vehicle defect, etc. Likely or not, it’s important investigations cover all possibilities. Otherwise, something important could slip through the cracks.
