Commentary by Attorney Michael Grossman
To this day, one of the most common misconceptions I encounter is that someone is automatically at-fault for rear-ending another vehicle. The reality is, just like any accident, it’s about why that happened and how it could have been avoided.
For example, if someone veers into another driver’s path, would they have time to avoid a rear-end collision? What if a vehicle is illegally parked without its lights on? What if the rear vehicle experiences a mechanical issue or a defect with a crash avoidance system? Likely or not, these are examples of things a proper investigation should consider.
If authorities are considering such possibilities here, that’s good. But if they, too, simply assume the worst of the rear driver, they might overlook something crucial the victim’s loved ones need to know.
