Commentary by Attorney Michael Grossman

Regardless of what happened here, Texas has the most complex work fatality laws of any other state in the country. It’s a legal maze that takes a lot of experience, legal tools, and evidence to efficiently navigate. Families can do so, but it’s not usually OSHA that gets them to a fair resolution. They have their own priorities, and that doesn’t usually overlap with the needs of a worker’s loved ones. So while OSHA may be tight-lipped about what they’ve looked into here, families will generally find the best outcome when they aren’t solely relying on OSHA’s efforts anyway.
