Commentary by Attorney Michael Grossman

I talk about single-vehicle wrecks like this all the time given how common they are and how complex they can be. A proper crash reconstruction needs to cover all kinds of intricate details—things even authorities sometimes overlook. Was there a mechanical failure? Did a tire blow out? Did the driver have a medical emergency? Was the road poorly lit, or was it improperly maintained or designed? Did a defect cause the vehicle to lose control?

Normally when I bring up these possibilities, people are open-minded. But they hear the victim was the only person involved, and suddenly that all goes out the window. They just figure the victim was on their phone, drunk, or speeding. Obviously, any crash investigator worth their salt would consider those possibilities. Even then, there could also be extenuating circumstances that need more attention.

Put another way, when people jump to conclusions, the best they can hope for is saying, “I told you so.” What good does that do when the alternative is blaming someone for something they had no control over? That’s why it’s best to just let the evidence speak for itself.
