Commentary by Attorney Michael Grossman

It may seem open-and-shut for reports to say that a truck driver failed to slow down and rear-ended traffic. However, it’s important that investigations determine why that happened.

Was the driver on their phone? Do they have a history of negligent driving? Are they inexperienced and poorly trained? Were they rushing to meet an unreasonable deadline? Were they behind the wheel for too long, skipping rest breaks and violating hours of service regulations?

Knowing who’s to blame for a serious accident is one thing. Ensuring there’s accountability for those responsible parties is another. Digging beneath the surface-level details to get the full story should always be a priority after crashes like this.
