Commentary by Attorney Michael Grossman

There’s not a lot of specific information here regarding visibility, right-of-way, and the exact moments surrounding the collision. I wouldn’t suggest blaming anyone without knowing all the facts. One thing to consider, though, is that New York is just about the number one place a driver should be watching for pedestrians and cyclists. Of course, even with that heightened awareness, there are situations a driver simply can’t avoid. But is this one of those situations, or would investigations show an attentive, careful truck driver would have been able to avoid this?
