Commentary by Attorney Michael Grossman

While things may seem open-and-shut when authorities are blaming someone after an accident, getting a full resolution may still involve more work. After all, it’s not about what you know; it’s about what you can prove.

I’ve seen too many examples of people assuming authorities gathered and preserved all the evidence they’d need to hold someone accountable after an accident. Instead, it turned out authorities only gathered evidence they needed to issue their citations.

As such, it can be important to follow up with authorities early on and make sure there are no gaps in the story. If there are, that’s where independent investigations can probably step in and pick up the slack.
